Olami Travel App is a mobile app and platform that connects Jews from all over the world by hosting one another and assisting with the necessary solutions for the Jewish traveler’s needs. Through Olami Travel, Jewish and Israeli travelers can contact Jewish families near their destinations, stay a night, join a dinner, ask for advice, and build new relationships with Jews from different countries around the world. Take note to understand the rules that apply to each prior to completing the registration process. For your convenience, we have separated the rules that apply to you as a Guest from those that apply to you as a Host in the Terms of Use below. All other rules outlined in the Terms of Use will apply to all users equally. Please note that the two designations (Host & Guest) are not mutually exclusive. That is, you may choose to be a host on a particular Shabbat and also wish to experience Shabbat as a guest at the homes of other families on another. We encourage our users to experience Shabbat both as guests and hosts, as each presents differing opportunities and perspectives on the Shabbat experience.

In the Terms of Use (the contract), the term “you” and “user” refers to all users of this App, including Hosts and Guests. The purpose of these rules is to create a comfortable, respectable, and safe atmosphere where Hosts and Guests can connect. Additionally, it is important for us to make clear, and for you to fully understand, that we cannot, nor do we, take any responsibility for any actions of other users or third parties. As such, when you offer or accept an invitation, any risks associated with the same is entirely yours. Please be sure to read the Warranties and Disclaimers in our Terms of Use for more information prior to offering or accepting an invitation, and of course, please take all precautions to keep yourself safe.

ACCEPTANCE OF TERMS

Olami Travel App including all information, documents, communications, files, text, graphics, photographs, software, products and services available through the App (collectively, the “Materials”) and all services offered by Olami Travel App and third parties, including individuals registered as Shabbat Hosts on the App, through the App (collectively, the “Services”), available for your use subject to the terms and conditions set forth in this document and any changes to this document that Olami Travel App may publish from time to time (collectively, the “Terms of Use”). By accessing or using this App in any way, including, without limitation, registering as a Guest or Host, use of any of the Services, downloading of any Materials, or merely browsing the App, you agree to and are bound by the Terms of Use. Olami Travel App reserves the right to change the Terms of Use and other guidelines or rules posted on the App from time to time at its sole discretion. Your continued use of the App, or any Materials or Services accessible through it, after such notice has been posted constitutes your acceptance of the changes. Your use of the App will be subject to the most current version of the Terms of Use, rules and guidelines posted on the App at the time of such use. You should periodically check these Terms of Use to view the then current terms. If you breach any of the Terms of Use, your authorization to use this App automatically terminates.

DEFINED TERMS

The term “Host” means an individual registered on the App as a Host, and the term “Guest” means an individual registered on the App as a Guest. All user-supplied information, materials, files, communications, guest-book entries, comments, and photographs are referred to collectively as “User Content.” “Olami Travel App Content” means all Materials provided by Olami. User Content and Olami Travel App Content may have different restrictions and conditions associated with them. The terms and conditions expressed in this agreement apply to all users and visitors of this App. By creating a User account on the App you are representing that you are at 18. If you are under the under the age of 18 years you are NOT permitted to use this App.

GUEST PROFILES, RULES; REGISTRATION

Standard Guest Profile. In order to create a standard profile, in addition to the information you would need to provide to create a Quick Guest profile, you will also need to provide the following information: your city, state, zip code, 2 references, dietary needs, and one picture. The Standard Guest profile allows you to include some optional information such as your occupation and general information about yourself. Olami Travel App shall be the final arbitrator as to whether a particular uploaded photograph is appropriate given the nature of the App, and Olami Travel App shall have the right to delete any photographs it deems, in its sole discretion, to be inappropriate. Please note that, upon registration, the default setting allows for other Users, namely prospective Hosts, to view your profile and offer the Guest a Shabbat invitation. This setting may be changed once you are logged in to your account. With a Standard Guest profile you will have the ability to submit direct requests to prospective hosts. Once a host accepts a request and confirms a reservation, contact information will be shared between the Host and Guest.

HOST RULES; REGISTRATION

To register as a Olami Travel App Host, complete and submit the registration form. You will be required to include all the information required to create a Standard Guest profile (See Section 4(B)). AGE: You must be at least 18 years or older to create a profile without the express verified consent of your guardian. To complete a Host profile you must upload at least one picture. The Host profile allows you to include some optional information about your family. Please use your discretion when uploading information about your family as we are unable to screen the App users or to vouch for their integrity.

RIGHT TO REMOVE MEMBERS

We reserve the right to reject any individual for any reason we see fit. There is no missionizing on Olami Travel App, Christian or otherwise. Any member reported or found to be missionizing will be removed from the App. There will be no sexual solicitation on Olami Travel App. Members who feel solicited or pressured must repost the incident and the offending party will immediately be removed from the App. Olami Travel App members are not to pressure other members to engage in an unsolicited or unwanted relationship. Pressuring members, making them feel uncomfortable reflects poorly on the spirit of Olami Travel App. Offending party will immediately be removed from the App. Olami Travel App is not a commercial App. While occasionally Olami Travel App may allow commerce posts and solicitations to remain, we reserve the right to delete these posts as well as to remove members who abuse this feature.

INTELLECTUAL PROPERTY; LIMITED LICENSE TO USERS

The Materials and Services on this App, as well as their selection and arrangement, are protected by copyright, trademark, patent, and/or other intellectual property laws, and any unauthorized use of the Materials or Services at this App may violate such laws and these Terms of Use. Except as expressly provided herein, Olami Travel App does not grant any express or implied rights to use the Materials and Services. You agree not to copy, republish, frame, download, transmit, modify, distribute, license, reverse engineer, or create derivative works based on the App, its Materials, or its Services or their selection and arrangement, except as expressly authorized herein. In addition, you agree not to use any data mining, robots, or similar data gathering and extraction methods in connection with the App. In addition to the Materials and Services offered by Olami Travel App, this App may also make available materials, information, and services provided by third parties (collectively, the “Third Party Services”). The Third Party Services may be governed by separate license agreements that accompany such services. Olami Travel App offers no guarantees and assumes no responsibility or liability of any type with respect to the Third Party Services. You agree that you will not hold Olami Travel App responsible or liable with respect to the Third Party Services or seek to do so. Except as expressly indicated to the contrary elsewhere on this App, you may view, download, and print the Olami Travel App Content and User Content available on this App subject to the following conditions: The Olami Travel App Content and User Content may be used solely for personal, informational, and internal purposes. Olami Travel App Content and User Content may not be modified or altered in any way. You may not remove any copyright or other proprietary notices contained in the Content and User Content. Olami Travel App reserves the right to revoke the authorization to view, download, and print the Olami Travel App Content and User Content available on this App at any time, and any such use shall be discontinued immediately upon notice from Olami Travel App The rights granted to you constitute a license and not a transfer of title. The rights specified above to view, download, and print the Olami Travel App Content and User Content available on this App are not applicable to the design or layout of this App. Elements of this App are protected by trade dress and other laws and may not be copied or imitated in whole or in part.

TRADEMARK INFORMATION

The trademarks, including “Shabbat” or a variation thereof, logos, and service marks (“Marks”) displayed on this App are the property of Olami Travel App. You are not permitted to use the Marks without the prior written consent of Olami Travel App LICENSE TO Olami Travel App FOR USER CONTENT Certain Services offered through this App, such as the guest-book, for example, accommodate or require User Content. Depending upon the nature of the Service, by submitting User Content to this App you grant Olami Travel App the following type of license: For User Content that is the result of your creative efforts and which is intended to be displayed on the App, you grant Olami Travel App a worldwide, royalty-free, non-exclusive license to modify (for purposes of formatting, maintenance, or App administration only) and reproduce such User Content. You also grant Olami Travel App the right to distribute and publicly display and perform such User Content for the purpose for which such User Content was submitted to the App. You agree that Olami Travel App may use your User Content for promotional purposes, including your photographs, comments, postings and the like.

PROHIBITED COMMUNICATIONS

You may submit only User Content to the App that is (a) owned by you, (b) submitted with the express permission of the owner or within the scope of the license to such content, or (c) in the public domain. You are prohibited from posting or transmitting to or from this App any unlawful, threatening, harassing, libelous, offensive, defamatory, obscene, or pornographic materials, or other materials that would violate any law or the rights of others, including, without limitation, laws against copyright infringement, and rights of privacy and publicity. Violation of these restrictions may result in denial of or limitations on access by you to this App. In using the App, including all Services and Materials available through it, you agree: not to disrupt or interfere with any other user’s enjoyment of the App or linked Apps; not to upload, post, or otherwise transmit through the App any viruses or other harmful, disruptive, or destructive files; not to create a false identity; not to use or attempt to use another’s account, password, service, or system without authorization from Olami Travel App; not to disrupt or interfere with the security of, or otherwise cause harm to, the App, or any Services, Materials, system resources, accounts, passwords, servers, or networks connected to or accessible through the App or any linked Apps.

MANAGING CONTENT AND COMMUNICATIONS

Olami Travel App reserves the right, in its sole discretion, to delete or remove User Content from the App and to restrict, suspend, or terminate your access to all or part of this App, at any time without prior notice or liability. Olami Travel App may, but is not obligated to, monitor or review any areas on the App where users transmit or post User Content, including but not limited to areas where Services are available, and the substance of any User Content. Likewise, Olami Travel App is under no obligation to post any User Content you submit, and Olami Travel App may, at its sole discretion, choose to not post your User Content. To the maximum extent permitted by law, Olami Travel App will have no liability related to User Content. Olami Travel App disclaims all liability with respect to the misuse, loss, modification, or unavailability of any User Content.

WARRANTIES AND DISCLAIMERS

Except as expressly provided otherwise in a written agreement between you and Olami Travel App, this App, and all Materials and Services accessible through this App are provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability or fitness for a particular purpose, or the warranty of non-infringement. Without limiting the foregoing, Olami Travel App makes no warranty that (i) the Services and Materials will meet your needs; (ii) the Services and Materials will be uninterrupted, timely, secure, or error-free; (iii) the quality of any Services or Materials obtained or accessible by you through the App will meet your expectations; and (iv) any errors in the Services or Materials obtained through the App, or any defects in the App, its Services or Materials, will be corrected. You understand and acknowledge that Olami Travel App does not screen its users and cannot vouch for the character or trustworthiness of any user on this App, and Olami Travel App cannot possibly control the actions of its users. As such, Olami Travel App makes no representations or warranties whatsoever about any Hosts or Guests accessed or introduced through the App, their character or trustworthiness. Any and all dealings and interactions, whether in person or otherwise, are at your own risk. You agree that Olami Travel App will not be liable for any harm that is caused to you by other App Users. The use of the Services or the downloading or other use of any Materials through the App is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage to your computer system, loss of data, or other harm that results from such activities. Olami Travel App assumes no liability for any computer virus or other similar software code that is downloaded to your computer from the App or in connection with any Services or Materials offered through the App. No advice or information, whether oral or written, obtained by you from Olami Travel App or through or from the App shall create any warranty not expressly stated in these Terms of Use.

PERSONAL INFORMATION AND PRIVACY

You understand and agree that we may disclose information about you if we have a good faith belief that we are required to do so by law or legal process, to respond to claims, or to protect the rights, property, or safety of Olami Travel App, its Users, or others.

LIMITATION OF LIABILITY

In no event, including, without limitation, negligence, shall Olami Travel App, its subsidiaries, affiliates, agents, officers, directors, employees, or partners be liable to you or any third party for any special, punitive, incidental, indirect, or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from injury or death, loss of use, data, or profits, whether or not Olami Travel App has been advised of the possibility of such damages or injury, and on any theory of liability, including torts, arising out of or in connection with the use of or the inability to use this App, its Services, or Materials, the statements or actions of any App User on or through the App, any in-person dealings or interactions with any App User or any individuals connected to such App Users, any unauthorized access to or alteration of your transmissions or data, any information that is sent or received or not sent or received, any failure to store or loss of data, files, or other content, any Services available through the App that are delayed or interrupted, or any webApp referenced or linked to or from this App.

INDEMNITY AND LIABILITY

You agree to indemnify and hold Olami Travel App, and its subsidiaries, affiliates, officers, directors, agents, partners and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party or User due to or arising out of content you submit, post to, or transmit through the App, your use of the App, your connection to the App, your physical actions against another, your violation of these Terms of Use or your violation of any rights of another person or entity.

GOVERNING LAW AND JURISDICTION

This App (excluding linked Apps) is controlled by Olami Travel App from its offices within the state of New Jersey, United States of America. By accessing this App, you and Olami Travel App agree that all matters relating to your access to, or use of, this App shall be governed by the statutes and laws of the State of New Jersey, without regard to the conflicts of laws principles thereof. You and Olami Travel App also agree and hereby submit to the exclusive personal jurisdiction and venue of the Courts within the State of New Jersey with respect to such matters.

GENERAL

The Terms of Use and the other rules, guidelines, licenses and disclaimers posted on the App constitute the entire agreement between Olami Travel App and you with respect to your use of the App. If for any reason a court of competent jurisdiction finds any provision of these Terms of Use, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected by that provision, and the remainder of the Terms of Use shall continue in full force and effect. Any failure by Olami Travel App to enforce or exercise any provision of these Terms of Use or related right shall not constitute a waiver of that right or provision
